If mediation fails to result in an amicable agreement, the dispute will then be resolved by binding arbitration in the City of Montreal, unless you and l\u2019Actuel agree otherwise, in accordance with the provisions of articles 620 and following of the Code of Civil Procedure, except in cases where applicable laws prohibit referral to arbitration or restrict a consumer’s right to go to court. <\/li>\n

Except in circumstances where applicable law prohibits restrictions on a party\u2019s right to bring a class action, all claims must be brought by the parties on their own behalf and not as plaintiffs or class members in any representative action or class action. Unless the parties agree otherwise, an arbitrator may not consolidate the claims of more than one person.<\/li>\n
